The Wayne County Office of the Sheriff reported the arrest on Thursday (9/25) at 2:30 a.m. of Zozimo Bautista-Rojas, age 26, of Fish Farm Road for DWI Leandra’s Law along with several other charges following an investigation on Brantling Hill Road in the Town of Arcadia.
Deputies responded to Brantling Hill Road for a 911 hang up call. Upon arrival, deputies located Bautista’s vehicle parked, blocking the roadway. Bautista was found to be under the Influence of alcohol. He was administered field sobriety tests, which he failed, and he was taken into custody.
Further investigation revealed that Bautista responded to an address in Newark to pick up his wife with his one year-old child in the car.
Bautista became upset at the wife and threatened to crash the vehicle. Bautista’s wife was able to get the keys out of the car to stop him from driving, She phoned 911 at which time the call was lost.
Wayne County 911 attempted to call her back and it’s alleged that Bautista took the phone from his wife and refused to let her speak with the dispatcher.
Bautista was charged with DWI/BAC of .11%, Leandra’s Law, two counts of Reckless Endangerment, Endangering the Welfare of a Child and Criminal Mischief in the Fourth Degree. He was arraigned in the Town of Arcadia Court and remanded to the Wayne County Jail.
