It took State Police out of Lyons almost two years to put the case together, but on Wednesday (1/27/16) Matthew S. Grimsley, age 32, of 6657 Waters Road in Red Creek was finally charged.
It all began on February 22, 2014, when Joseph Telarico of Wolcott, estranged from his wife, went to get a tattoo. Once at the tatoo house on Helch Road in Lyons, the man’s wife allegedly pulled into the driveway and texted her estranged husband on his cell phone, asking him to come outside to talk. Telarico refused, telling her he was in the middle of getting a tattoo.
The estranged wife’s new boyfriend, Grimsley, was also outside, waiting for the man to come out. Police alleged that Grimsley then took a hammer to the man’s pick-up truck, knocking out the windows and headlights.
Not at all satisfied, Grimsley found the man had left his keys in the truck. He allegedly placed a block between the gas peddle and seat and sent the truck travelling down the road. At first, the running, unmanned truck went into a field, but unexpectedly pulled a u-turn. The unoccupied pickup truck then traveled across Helch Road into a field, struck a fence, traveled through an in-ground swimming pool area and came to rest inside of a private residence at 8833 Helch Road in Lyons, owned by Joanne James.
Grimsley was charged with Grand Larceny in the third degree, Reckless Endangerment in the first degree and two counts of Criminal Mischief in the second degree.
The collision resulted in an estimated $38,000 in damage to the residence and $4,000 damage to the stolen truck. Joseph Telarico, the truck owner, has meanwhile moved to Colorado.
Wayne County District Attorney, Rick Healy said the case will be presented to a Grand Jury and that if convicted, Grimsley would be required to make full restitution to the victims.
On Friday, Joanne James said that her homeowner’s insurance policy covered the cost of the repairs, minus the deductible. “Whose insurance company are they going to go after,” questioned the homeowner.
Grimsley was arraigned in front of Town of Lyons Town Justice Larry Hartwell and committed to the Wayne County Jail in lieu of $10,000 bail. Grimsley is scheduled to reappear in the Town of Lyons Court at 9:00 a.m., on February 1st for a preliminary hearing. He was released from jail on Friday morning by Court Order.
